The request for a commercial proposal sent to a potential counterparty and the document on the provision of price information in the EIS must be identical in content.

Request in accordance with 223-FZ
A document with a request for a commercial proposal can also be used for purchases according to 223-FZ. It does not have a clearly regulated structure, so each customer independently determines the form of the request, while observing the business style of writing and the norms of commercial etiquette.
The main purpose of a request for a commercial proposal is to obtain information from the maximum number of suppliers to determine the optimal initial contract price and conclude a profitable deal. The text of such a document from a state-owned company must include:
the reason for the request (with reference to 44-FZ);
the most accurate and detailed description of the procurement object, including name, units of measurement, required quantity, volume, article number, technical specifications;
main conditions for the execution of the contract: requirements for the delivery scheme, procurement deadlines, payment procedure, the amount of security for the execution of the contract and warranty conditions;
desired period for providing price information;
an indication that the response to the request must clearly define the cost of a unit of goods and the total cost under the contract on the terms specified in this document, an example of its calculation, and the validity period of the price offer;
a reference to the fact that the procedure for collecting cost information does not entail obligations for the customer is not a basis for concluding an agreement.

A request for a commercial proposal in accordance with Federal Law No. 44 must also contain the following information:
full name of the customer organization;
its details: address (postal and legal), telephone number and other data;
Full name of the responsible person, his/her position and signature.
The request is signed by an authorized specialist and sealed with the organization’s seal.
It is recommended to use this same scheme when compiling a request in accordance with Federal Law 223, as it contains comprehensive information.
Unlike a request for a commercial proposal from a private company, such a document from a budgetary organization details the technical characteristics and terms of delivery of the required product, as well as clear requirements for its quality. In some cases, for convenience, a table is made with a description of the product, followed by the terms of delivery.
